    PNoy signs law against
    drunk, drugged drivers



    MANILA – President Benigno Aquino III signed into law Republic Act 10586, or an Act Penalizing Persons Driving under the Influence of Alcohol, Dangerous Drugs, and Other Similar Substances.

    RA 10568 signed on May 27, seeks to promote safe and responsible driving and curb motor vehicle accidents.

    In a press briefing, Deputy Presidential Spokesperson Abigail Valte, said the new law now mandates driver's education to cover part of either -- to get a license and for renewals.

    “The driver's education should now include the course on the information relative to safe driving, including the consequences of driving or operating a motor vehicle under the influence of the aforementioned substances," she added.

    Law enforcement agencies are now empowered under the new law to conduct field sobriety, chemical, and confirmatory tests.

    If the driver fails, and if the law enforcement officer feels that there is any indication that the driver is under the influence of the relevant substances, the officer may ask the driver to undertake a sobriety test.

    If the law enforcement officer also feels that the driver has failed a sobriety test, he can be subjected to the use of a "breathalyzer" to determine the alcoholic content of his/her body at that particular time.

    Valte said RA 10568 also mandates the mandatory alcohol and chemical testing of drivers involved in motor vehicular accidents.

    The new law stated that offenders who have not caused any physical injury or homicide shall be fined from P20,000 to P80,000 and face three months imprisonment.

    The fines get heavier too -- from P100,000 to P200,00 and imprisonment from three months to 12 years if the violation results in physical injury.

    If the violation involves homicide, the fine goes up from P300,000 to P500,000 or imprisonment from 12 years to 20 years.

    The non-professional driver's license of violators will also be suspended for 12 months for the first conviction and perpetually revoked on the second conviction.

    The Land Transportation Office is authorized to deputize traffic enforcers from the Philippine National Police, Metropolitan Manila Development Authority, and cities and towns to enforce the new law.

    Wow, those penalties are insane.

    How will a regular hard working Filipino pay these fines ever?

    The cops will have a field day with this one, I am sure you will now be left alone even if you sit on the steps to the cop-shop shooting heroin in to your arm with a basket of sawed off heads sitting next to you. The cops will be too busy catching guys who had 3 beers on the way home.

    And if there is ever an accident, police will be on the scene in 37 seconds flat and if nobody were drunk at the donut shop less than a minute later.

    Back in Denmark a drunk driver pays what is equal to 1 months salary.

    20K-80K pesos if for most working Filipinos 3 - 12 months salary - and they wont earn any money the first 3 months while they are locked up.

    Wouldn't want to be the 30th + person to have to use the breathalyzer, I'm sure they will be pretty nasty and probably enough accumulation of .08 to give you a 4.0 reading. Probably better to carry a 1000p bill with your drivers license.....

    Oh boy. The powers that be will have a field day with this one, especially in the run-up to Christmas.

    By comparison, the following rules apply in U.K., for a first offence and depending on the blood/alcohol count :-

    Up to 6 months imprisonment.
    Up to 5000 pounds fine (approximately 320,000 peso)
    At least 1 year banned from driving. (The driving ban may be reduced by 20% if you attend an alcohol awareness course).
    Additionally, the conviction is recorded on your driving licence and remains there for 10 years, and your mandatory car insurance will probably increase by 300% at least.

    I reckon that if any Filipino earns enough to pay the fine, they will also have enough to buy their way out of any legal proceedings.

    It is better to follow the law period. Do not drink and drive. The problem in Dumaguete is transportation, like no taxis.
    One reason for living in Bacolod...because we have as many taxis (all with meter and radio communication) per capita as New York City. They are like bumble bees...
    TAXI = private chauffeur, no gas bill, no oil change, no maintenance, no insurance, no car wash, no accident responsibilities, drinking is no problem...etc. etc. Cheap transportation.
    Hope Dumaguete City catch up soon as part of their interest in tourism and convenient transportation for all who needs it.

    I hope they have done this a long time ago. Take it for an example that accident that killed a mother and the husband got amputated from a filipino driver who was under the influence of alcohol. Im talking about the one that smashed her toyota hilux to a suzuki multicab?

    To settle the issue, she pays the husband 50k as well as the hospital bills but the point is, its the life thats been taken here and kids growing up without a mother and a father that wont be able to look after them and even himself because his legs have been amputated.

    i wish drivers can be more responsible, its not just you out there, if you cant handle it then dont drive or dont drink!
