PARTLOW Tension broke out but simmered down quickly when a Filipino-Chinese businessman attempted to have a structure erected on his property in Barangay Daro, Dumaguete City, demolished yesterday afternoon. Carlos Ang Gobonseng, president of the Gobonseng Enterprises Inc., ordered again the demolition of the M Lhuillier branch occupying some 24.79 square meters of his four-hectare property in Daro, after he received a copy yesterday of a court order dismissing the temporary restraining order filed by the pawnshop establishment against him. But M Lhuillier, through its regional manager, Leif Branzuela, bucked the move, insisting that the lease contract that both parties had entered into was legitimate and binding until 2023. Branzuela said they did not receive any order from the court to vacate or demolish the branch, and declined to discuss the TRO that his boss had earlier filed against Gobonseng, but was dismissed Monday by Judge Mary Rose Inocando-Paras of the Regional Trial Court Branch 42. Gobonseng wants the pawnshop to vacate the area as he already leased it as part of the 1,500 square meters lot to a fastfood chain that intends to put up a drive-through soon. Branzuela said they continued operating the branch because they were up-to-date with their rental and the lease contract was not cancelled. Branzuela said they will continue to operate the pawnshop as their legal counsels are now working to settle the issue with Gobonseng. He added the four security guards deployed 24/7 are precautionary measure to protect the business. Gobonseng, whose workers had started putting up a barbed-wire cordon at the site, called off the demolition to avoid a violent confrontation. But he vowed to return with more workers to undertake the demolition of the pawnshop’s building. Meanwhile, the Dumaguete City police deployed some of its personnel at the height of the tense confrontation but they monitored the event from a nearby gas station.*JFP
The fast food chain must have offered more money. These are the reasons the country won't see more foreign investment. You can't trust the people you are doing business with to honor contracts......and the courts won't uphold them either. On a side note: this landlord should be very careful, the family that owns that pawnshop franchise is an extremely powerful one. The property owner had better hope they don't get involved in this spat.
