    Got a link for that? I found the following but nobody said there was not eminent domain in the Philippines. The thing is, it requires due process. So far I haven't heard that there was any process, due or otherwise.

    Eminent domain, commonly also referred to as condemnation, is the power of a government entity to claim land which is needed for a public purpose, but only after following due process and equitably compensating the owner for the value of the taking.

    How true? Propeller type from Manila to Dumaguete? It means longer time to travel, passenger and luggage limit? I hope it will be resolved soon. It will hamper the tourism activity in south of Negros island. Worst if CAAP will decide the closure of the airport.

    They will not close the airport. There are not that many flights in and out of that airport anyway. I had to wait two days to get a flight to Manila one time. Big Whooptie. There would probably be more flights with turboprop planes.

    Big pain is when coming from USA. All that Pasalubong can cost some serious pesos for an overage or you may not even be able to bring it. I thing that alone would motivate the locals.....LOL.

    Pay the guy an appropriate sum and move on. If you can't solve this problem, just imagine the really tough ones like traffic. :thumbsup:

    Eminent domain - Wikipedia, the free encyclopedia

    Your right mate. In the UK we know as Compulsory Purchase, in the Phils Eminent Domain. Can't find the link I looked up earlier...it was about the government doing the Eminent Domain thing for road building over Sugar Cane farm land. Needless to say the Big Corp that owned that land tried to raise a stink. It was full of legal jargon and rather tedious being the judgement itself.

    This joker just owns a few trees and is not Del Monte or whatever Mega Company. Compulsory Purchase of a few trees shouldn't be hard to do particularly if the powers can be delegated to City government.

    I'm not saying it is right, but it is a solution if an impass has been reached. On the balance of probabilities it might be in the public interest - but then again - the words public and interest don't often make happy companions in the Phils!

    Exactly! There is a legal remedy. You seem to get it. For those who don't:

    The guy probably isn't thrilled with living there anyway after the damage to his house and not getting reimbursed for it. I consider his letting the tree grow, probably fertilizing the heck out of it is an act of self defense of his house.

    There is a legal remedy. The house, land and tree owner has done not a d*mn thing wrong just living and conducting his business. But people are b!tching about him. The tree owner couldn't even get them to fix his roof after they damaged it and had to pay for it out of his own pocket. If he couldn't make them pay for damages they caused, evidently he isn't the one with the power to solve things equitably. How about some b!tching for a change about the people who do have the power to make an equitable resolution to the problem and whose job it is who aren't doing their job?

    People are really quick to hate on individuals. There were actually people on this forum who were wishing something bad happened to the Ramos family of power outage fame. You people know exactly who you are, as do I but I'm not going to name you. I will merely remind you that as you sow, so shall you reap. You don't have to be religious to see the truth of that.
