For five years, Scott McMahon languished in an overcrowded jail in the Philippines, awaiting trial for a crime he swore he did not commit.

This month, a court in Manila agreed with him, acquitting the Seattle man of two rape charges. The court also questioned the credibility of the accuser, citing discrepancies in her statements.

Still, McMahon is not completely in the clear.

The father of three has not been allowed to leave the Philippines, and concerns are mounting that he could be rearrested at any time because of a $3,000 fine the country's Bureau of Immigration wants him to pay for his expired visa.

McMahon would not have owed that money had he not been incarcerated since 2011, according to a U.S. organization that helps people facing legal problems abroad.

McMahon's visa expired in 2013 while he was in jail; the Bureau of Immigration is charging him $1,000 for every year that his visa was not renewed, Eric Volz, managing director of the David House Agency, told The Washington Post. The organization has been providing services to McMahon at no charge.

Volz, who has been communicating with McMahon's family and attorney in the Philippines, said McMahon has the option to appeal the fine. If that succeeds, he will not have to pay.

That process, however, is lengthy. So McMahon's family is choosing the faster option: paying the money.

To do that, though, McMahon has to submit an affidavit explaining why the visa expired in the first place, Volz said. The review process for that could take up to three weeks. After he beat rape charges abroad, an American could land in jail again over an expired visa

Sad situation. Reads like an ugly 'Locked Up Abroad' story. Surely there is a hateful history behind this. Another apparent example of a foreigner getting screwed.

I would phone 8888 Duterte's complaint/whistleblower number and ask them to look into this case and the blatant scam.

You have a good idea there.
Duterte may be harsh at times but I think he would not endorse that nonsense from the BI.
It would probably be better if someone that spoke Tagalog or visaya made the call.

Common sense and logic really hasn't prevailed in this guys case. You would think the bi would show some sensitivity here as they guys case was thrown out of court. How the hell was he supposed to renew his visa whilst in jail,I'm sure he would have if he hadn't been stitched up by some wh- - - e!

Is that not what the appeal process is for? It sucks the guy got caught up in the nonsense but there is absolutely no way immigration can keep up with all the nonsense foreigners get caught up in here.

Note: we also have no idea if this guy was up-to-date on his visa renewals prior to being locked up.

Putting a few articles together. He was in jail for 5 years. Fine for overstay is p1,000 per year. His fine is p3,000.

So in jail 5 years but overstayed 3 years? Not sure how that math works?

I have read that it could be a lot more than $3k in fines. That is just an estimate. Even when they fine you, your visa must still be brought up to date and that is more than $3k when you add in all the nickels and dimes and express lane fees for express service you never received, it still must be paid for.
