    I was checking out for kin the latest BOI Advisory after PH reimposed a temporary ban against foreigner entry beginning March 22 until April 21 and the IATF ordered reduction in number of inbound international travelers to 1,500 a day at each international airport.

    There is no lifting amendment but there is a reiteration in today's Press Release, posted at https://immigration.gov.ph/images/News/2021_Yr/04_Apr/2021Apr07_Press.pdf, clarifying that the Balikbayan privilege allowing visa-free entry of foreign immediate kin remains suspended, so that the foreign parent, the foreign spouse, and the foreign childen of Filipinos each must secure a valid visa from a PH foreign post abroad to be able to enter the Philippines.

    It is
    further clarified that, even with a valid Philippine visa, the foreign parent, the foreign spouse, and the foreign children of Filipino citizens still cannot enter the Philippines if they are traveling unaccompanied by the Filipino immediate kin.

    It was confirmed that, a Filipino's foreign child who is a minor (below 18 years old) and who is travelling unaccompanied by his adult Filipino immediate kin or alone with airline assistance, can enter Philippines if he is holding a valid Philippine passport. At this time, pre-arranged airline assistance for the minor all the way to the arrival greeters' area is very important because MIAA issuance of a Meet & Assist Access Pass ID, that allows a non-passenger kin airport entry up to the arrival baggage claim or immigration clearance area, continues to be suspended due to the CoViD-19 situation.

    It was also confirmed that a foreign parent or a foreign spouse travelling with a Filipino's foreign child, even though both are unaccompanied by the Filipino immediate kin, can be considered to enter the Philippines if his accompanying foreign child holds a valid Philippine passport.

    So this means even with a 13A visa you are not allowed entry if your wife is not with you ?
    Does anyone understand the significance of your wife having to be with you ?
    This is a genuine question, i just want to find out if i am missing something because no matter how hard i think i cannot understand the logic of this, if there is any .

    It is very confusing. The text above referred to Balikbayan privilege. This does not apply to holders of 13A. If you plan on traveling and need to know, it would be best to ask the BI.

    The suspension of BalikBayan visa-free entry privileges (by the DFA, effective March 22, 2021) is mentioned in BOI Press Release of April 7, 2021 only for the purpose of clarifying BOI Advisory of 2021 March 31, 2021.     You could be missing NTF Memorandum Circular No. 5 of March 16, 2021 which temporarily banned entry of foreigners and Returning Overseas Filipinos (ROFs) who are non-Overseas Filipino Workers (non-OFWs) from March 20, 2021 to April 19, 2021 "... to prevent the entry of SARS-CoV-2 variants from other countries and the rise of cases..."

    Subsequently, IATF Resolution No. 103 of March 18, 2021 ratified NTF Memorandum Circular No. 5, s. 2021, amended it to allow entry of all Filipino citizens, whether ROF or OFW, and affirmed temporary ban on entry of foreigners effective 0001H March 22, 2021 to 2359H April 21, 2021, with the exception of:

    i. Diplomats (holders of 9(e) visa or 47(a)(2) visa);
    ii. Foreign nationals escorting medical evacuation of a repatriating Filipino;
    iii. Foreign seafarers under the “Green Lanes” program for crew who hold valid 9(c) crew list visas;
    iv. Foreign spouses and children, of repatriating Filipino citizens, who hold valid visas; and
    v. Foreigners, having emergency or humanitarian concerns approved by the NTF, who hold valid visas.​

    To implement the above policy, the BOI formulated and issued BOI Advisory of 2021 March 31, 2021 that is being clarified by the Press Release of April 7, 2021.

    The significance of your wife's being with you is that, being citizens of PH, your Filipino wife or child/ren can enter PH any time; whereas you, being a foreigner, can enter only by the rules. Right now, the general rule says you and all foreigners are temporarily suspended from entry subject to exceptions to prevent entry of SARS-CoV-2 variants from abroad. If your Filipino wife or child/ren is returning to her country and you with your 13A visa is accompanying her/them, then your entry becomes an exception by the rule. If you travel to PH on your own at this time without your Filipino wife or child/ren, your attempt to enter could be suspiciously non-essential and may raise curious questions such as: Why do you leave your Filipino wife and child/ren abroad to travel to PH by yourself at this time of global pandemic? What will you do in the Philippines, alone, without your Filipino family, wife or child at this time of public health emergency and national calamity?

    Therefore, even with a 13A visa, you are not allowed entry if your Filipino wife or child is not with you.

    Still makes no sense, what if my wife is still in the Philippines and i had to leave for work or some other valid reason.
    This means for me to return to the Philippines my wife and family (if nobody available to look after them) would have to travel which i think she is not allowed to as not an OFW to meet me somewhere then we enter the country together, why make people do unnecessary travelling in this time of pandemic ? :banghead:

    As if anyone needed further information to understand how badly outdated and backwards the government of the Philippines is, look no further than this sentence: "Previously issued advisories inconsistent herewith is hereby amended." Such a beautiful place and people to have such a dumpster fire of a government.
