Girlfriend in motorcycle accident.

    Been a while since I posted here. My girlfriend was involved in an accident as a passenger on a motorcycle. She was with a coworker friend and they were following another pair of coworker friends on another motorcycle. She was wearing a helmet, but it was damaged in the crash, and the bike landed on her. The driver of her motorcycle was trying to overtake another vehicle on a corner on a hill.
    She's suffered some head trauma, resulting in some blood clots in her brain. She's recovering and they started physical therapy at SUMC.
    Her sister says that Philhealth might not cover it, because the driver of the motorcycle is not licensed. (Is this true?)
    Her sister is going to the Pamplona police station to get the accident report because they will need it to file the insurance. But they are almost certain that it won't be covered because the driver was unlicensed and left the hospital without filing philhealth. I don't know if that means they paid cash, or what? But, I'm just happy she's alive and able to recover. Just uncertain about the insurance situation. She has it, but it sounds like it might not be covered due to circumstances that I don't think she could have anticipated.

    As far as I'm concerned, I think the driver is liable regardless of whether they have a license or not. But I know things work differently in the Philippines. It'll probably all fall on her in the in the end, which, ultimately will mean I'll probably have to cover it, because I know she has no savings to speak of.
    She works for a call center from home. (I wonder how forgiving they are for her missing work?) I guess we'll find out.

    I guess I'm just wondering if anyone else has had any experience with anything like this? Just wondering what to expect.

    It does not seem likely the cause of the accident/illness should factor into Philheath covering part of the cost or not covering anything.
    Every year when I renew my OR (smoke test) I get a little insurance policy which I think provides liability insurance. The liability policy covers something like 100K pesos. You might want to look into that.

    Sorry to hear of your troubles Bd.
    Hope she makes a full recovery and things get back to normal.
    I cant speak for PI insurance cover, but in UK no licence, no valid insurance.
    I trust her co-worker will do the right thing and help out.

    Yeah, kind of looking like Philhealth doesn't want to pay on this. Looking doubtful the driver will help pay it as well. She's doing physical therapy because her left side is affected by the brain injury. Not sure what her options are at this point. Unlicensed motorcyclist seems to = no insurance as well. This is really frustrating as it was not her fault and had no idea that her friend was unlicensed.

    It might be a good idea to contact a lawyer about this situation...if the owner of the bike comes from a family with a bit of money (can't squeeze water out of a rock). I believe in the Philippines the owner (not necessarily the driver) of the vehicle is responsible for all damages caused by their property.

    Would PhilHealth play ball with the DTI? That might be another option.
