Beach mining

    Good morning,
    We live on a beach property and have been having issues with the locals mining the sand and rocks illeagally. It seems a few families are involved in selling the materials. We contacted our Brgy and DENR but have not seen any enforcement. Just wondering if anyone else delt with this issue and if yes then were you able to stop it?

    I live where there is illegal river dredging and the authorities have many times tried to stop it as the more they dredge (by bucket and hand) year after year now....... the river bank keeps eroding inwards. Same in your case they do it for selling cement bags full of sand and rock. There will be no stopping it as they will just do it at night. Also............best advice is try not to get involved with a locals lively-hood as the grudge will never go away and you may be in harms way. Let them dig a hole to Brazil and perhaps they will fall into it and disappear.

    Just start a rumour that there is buried gold from WW2, 4000 yards further down the beach.

    When you buy beach front property do you own the beach to the high tide line, low tide line or the point where the beach starts. Just curious if it's like California, where no person can own the beach.

    I thought it was 10 meters from high tide and beaches in the Philippines were all public land. I've heard of resorts claiming beaches/refusing access because they maintain/clean the sand but I'm not sure this is legally enforceable. Not sure why anyone would want beach front property these days. It's almost certain that it will be gone or seriously reduced in the next several decades.

    The beach is supposed to passable for everyone.
    If you have a beachfront lot you can apply to the DENR for a foreshore lease. The lease prevents outside people from hanging out and having a picnic on that bit of sand.

    Many years ago we looked at a lot of beachfront property, one lot we looked at was marketed as 500sq m but when we viewed it we saw that it would only be 500 at low tide, at high tide it reduced to around 300, we declined.
    Last week we had a walk around that area and someone has built what looks like an apartment building or maybe resort on the same lot and built right out over the beach so they can use the whole 500.
    I don't know how long they expect the structure to last with waves breaking on it unless it has some serious foundation or how they got permission to do this but it has definitely been built and almost finished by the look of it.

    The answer regarding the 10 m easment from the high tide mark is where no permanent structures are allowed to be built. This is not enforced AND the high tide line is not where the water is day by day, it takes a property survey to provide both the high tide line and the 10m marks are.

    In our short time here we have seen a change in the seasonal changes. This year the corrigated fence and post were washed away, the neighbor lost 2 trers, and another house had the foundation under their cement wall eroded (they now have floating steps to the beach).

    We are not worried about locals liking us, we crossed that bridge over a year ago. We have our space and enjoy it. Also, everone is afraid of our unfriendly dogs. The hardware store delivery guys prefer to leave stuff at the gate and leave vs. dropping materials off by the house. LOVE our dogs!!!

    Side note, we are blessed with being on a bluff with over 5m elevaton (it is also the highest point in the area) so we have had talks about how great it would be for a 3m storm surge. We may loose a dozen coconut trees but the village would be washed away. Then I keep in mind their social-economic situation and realize that I don't know what I would do if the roles were reversed. I don't wish harm nor calamity on anyone.

    Relax lad, they were the same stones and sand that have fed them for years long before you or I came on the scene and will be the same stones that they, me, and possibly you will get buried under so as the locals say "calma lang", as the mentioned official offices will make it known, and lose no sleep over it as to who is doing the complaining and getting in the way of their earning a crust。
