The empty lot next to mine has several big mango trees. One has some large branches going over the top of my six foot block wall into my yard, with several mangoes on them. So am I entitled to those mangoes? Doesn't make sense to ask the owner to cut down the branches coming into my lot.
Not sure on the law here pat but makes sense anything encroaching over your property line can be cut off, in UK we had same issue but the law states you have to offer whatever you cut back to the owner first.
Pat. My neighbours tell me yes, I base this on something from last year, They Claimed an Arm of Bananas that overhung their garden Actually they came round and gave us 3 hands as a Gift, We laughed, they give us our own bananas as a gift. JP
Would they know if they went missing? Maybe just "accidentally" hit the mango with a stick and when it falls to the ground (on your property) just say, "oh look what I found". lol Joking aside, mango are quite cheap at the market and I wouldn't risk making an enemy of a neighbor for a couple pesos. If the tree is damaging your property in any way it might be worth asking the owner to cut them back or if you could do it for them.
If they claimed the bananas on their side last year, why would you have problem claiming the mangoes this year. Offer them a few as a gift ;-)
