You should be OK as long as you don't rent from a guy named Louie Byrd, you will never see your deposit from him again.
Unfortunately renting from locals you should not expect your deposit back as they just don't have it to give you. If you pay a month or two months deposit tell the owner you are leaving and can you get deposit back at the end! If not as many have said tell the owner you will use the last month or two and use your deposit up. As per usual they will not be happy about this and if the question it just report to the barangay captain and hopefully it will be sorted. I know of several westerners who have done this and it usually turns it ok as long as you have a signed contract via a lawyer. Good and bad landlords everywhere in the world.
I Never give a deposit 1st and last months only...Tell them they can inspect the premises any time they want...and I can show them bills are paid ................. you will never see a deposit again
I wonder sometimes if the locals actually know the Legal difference ( and if that mattered) between a Down Payment and a Deposit. Now if you Buy a car, the Down payment is Part of the Sale, the Deposit would merely secure it until your finance is in order. Obviously a Down payment would be non Refundable and I would not pay anything until my Finance was sorted. in this case but for Rentals All deposits should be Refundable (less those fees needing to be retained for whatever reason) and of course should be stipulated on any Agreement that should Bind both ways. Now when ever I see the Word "Down Payment " as against "Deposit" I would always say/ask So the Down Payment is 1 or 2 months rent and 1 months Deposit Yes? I could go with this as it would normally be a minimum Stay of say 6 months. this is my take on it any way. JP
Then I can only say the two owners of Apartments up here certainly don't, I have read some agreements and only the Word Down Payment appears and they are pretty poor Agreements at that. So no wonder they are against giving any money back. Obviously not knowing the Difference. JP
