Ombudsman orders dismissal of Negros Oriental gov,Roel degamo

    DUMAGUETE CITY—Ombudsman Conchita Carpio-Morales has ordered the dismissal from the service of Negros Oriental Gov. Roel Degamo, provincial treasurer Danilo Mendez and provincial accountant Teodorico Reyes for grave misconduct in connection with the disbursement of calamity funds.

    But Degamo is appealing the order and may yet be spared from its enforcement as a result of the so-called Aguinaldo Doctrine.

    In a resolution dated March 16, the Ombudsman also ordered the cancelation of eligibility, forfeiture of retirement benefits and perpetual disqualification from government service of the three provincial officials.
    The Ombudsman also found probable cause to file 11 counts of malversation of public funds through falsification and for violation of the Anti-Graft and Corrupt Practices Act against the three at the antigraft court Sandiganbayan.

    Of the three officials, only Degamo’s penalty could not be implemented because of his election in 2013.

    Under the Aguinaldo Doctrine, reelection extinguishes the administrative liability of an elective official.

    Degamo, Reyes and Mendez have appealed the decision of the Ombudsman.

    The governor told reporters on Tuesday that reports about his supposed dismissal from the service were mere propaganda to discredit his administration.

    Provincial Attorney Richard Enojo said the Ombudsman’s order was not final yet since it could still be brought to the Court of Appeals and the Supreme Court.

    The Aguinaldo Doctrine was/is an actually defense. About a year (or so) back I read that the Supreme Court declared it un-constitutional as it was not in keeping with the constitution. I posted a link about that SC ruling to this form but can't find it. I thought the SC ruling was important at the time so I posted it here.
    Either the story I read about trashing the Aguinaldo Doctrine was not true or this recent article is not true, take your pick.
    It's pretty hard to know what the truth really is in the media here in the PI.
    For a couple of years I used to read several of the major PI news papers on stories that interested me. Every newspaper had a slightly different version and I would try and reason out what the actual truth was (or might be). In the last year I have pretty much given up try to understand because it has become apparent the newspapers report whatever the heck they think their readers want to hear.

    And that is why they will "kill" their political opponents because if they win they will have not any opponents running against them. With no opponents to face, they will win and not have to face justice because they would be re-elected official . Come on... these politicians stay up all night playing "monopoly" of the Philippines resources including defining the use of the "get out of jail free card" just so the hungry stay hungry and the poor stay poorer, and sell their votes cheaply.

    It is a simple political system here, designed by politician for the surviving politicians… law of the jungle type program… hahahaha (anyone heard of the unsolved Maguindanao gruesome massacre six years ago of 58 political enemies, that still has no convictions, but one of the suspects is running for political office this election (remember if he is e-elected then he can not face trail for the murders) , or the unsolved assassination of Ninoy Aquino 30 years ago, the President’s father, at the International Airport, Pasay with very few people on the tarmac. The Philippines still has not figured out who killed him). As Expats we think we are abused by Filipinos at times… what about the political Filipinos abusing each other. There is a simple reason the Philippines does not want foreigners involved in politics here… they want to keep us alive. :o o: They are such a benevolent group.. those politicians....:wtf:
