    Just wondering what my medical records the VA are waiting for, from the 60’s will state. Mine are from remote regimental, Island, and Camp hospitals. Has anyone actually looked at their service medical records?

    Yes I have, what the VA will be looking at in your medical records is if you were ever treated for something that could be related to the disability you are claiming. That is what they will use to determine "service connected".

    As for adding new evidence you will still keep your original claim date to!! That date will never change, me too, I got one of those big checks from SSA. It was huge, I never applied for disability with them till like 5 years later, and that was denied 2 times, when it went to a judge finally it got approved right away and they back paid me all the way back to my retirement date!! Plus my kids get a check every month to. If you are 100% and can not work apply for SSA disability, you will get turned down one or two times that is because they are trying to make you go away!! But stay with it and the judge will always make the right decision on your claim!!! Goose out

    You are not submitting a new claim!!! You are adding new evidence to the claim you already have, so nothing changes!! But I don’t know how the new appeals process is working these days so you never know!!! Goose out

    OK, adding new evidence to a previously denied claim is the Appeal Process. You are disagreeing with their decision and providing them more proof in support of your claim.

    It is a sad way to go since according to VA Rules and Regulations they are supposed to be the ones to obtain all evidence on behalf of the Vet, yet in many circumstances it is not the case, and if there is any doubt, the benefit of doubt must be weighed in favor of the Vet. My Judge chastised them over this and demanded that they get the right info that I told them where it was.

    Now, you mentioned something about Social Security Disability and advised people to file if they are 100%. First, they have to understand the insured status and special insured status. You have had to have worked at least 5 years before your disability onset. If you have been out of work for 6 years, you do not qualify. Another thing is you cannot file if you are older than 65. Not being able to work is one qualifying factor, but there are other insured status factors too.

    But I will agree with you, they try to make it as frustrating as possible in the hopes that you give up. I have helped several expats over hear that gave up and then they got their benefits because we refused to just quit.
