    Well, I would want him to stay here because, 1. It's cheaper on the US, and 2. he committed the crime here, not in the US. But first he has to be convicted.

    They wont deport him until his trial is over and sentence are served, if he lives that long 9(doubtrful)

    That is if he goes to trial. My comment is deportation avoids the embarrassment of airing this stuff in court. They sometimes avoid this by deportation.

    A knowledgeable source advises that he was freed from the first bust with a plea bargain, on a kind of parole. He was free to relocate, but ignored all advice to do so.

    He is a terrible image for Filipinos to use as an American example, IMHO. But if the plea bargain was offered, I would presume that his attorney saw a convict able outcome. Otherwise, why plea out? Argue chain of control or warrantless search, etc.

    The same thing would have been done by any respectable lawyer in any country. The job is to make sure your client is getting a fair shake. Not knowing who has handled the evidence is a massive red flag and opens the case to abuse and corruption. It's not a loophole, it is the police and prosecutor not doing their jobs correctly. You generally don't see this in the West (though I'm sure it still happens quite a bit) because police and prosecutors are well trained and competent most of the time with these things and know that if they don't the case will get thrown out by the judge...and I'm sure the judge would have some choice words for the police/prosecutor who screwed up so massively. If I were a police chief heads would be rolling and I would be demanding some resignations. But no heads will roll or resignations will be submitted because, as you said, "let's remember where we are." :wink:

    I found it necessary to reply as it bothered me when I read the comments. I didn't plea bargain or bail on my first case. Officers lied about everything. There own evidence and there prior testimonies prove it. They lied and said my son wasn't there, that I was with 2 unknown girls. It was my gf of 4 years and her cousin was in the spare room.i had sublet the house out and only returned a few days before. I won my case December 27th but for reasons no one can tell me was released in March. I couldn't let it go and had decided to file charges on 2 of them with evidence that they could not dispute, there own testimony. They trashed the house to make it look like a drug house.the plan was in the 3rd week of June to file and wait in Cebu. At 3:30 on the 15th officers entered my room as a friend who was going to pick up my birthday cake left they said they came at 8. We have subpeoned the CCTV tapes and the manager clerk guests will verify what I say. They said I was selling g drugs to numerous customers, then why only 230 pesos in the room. This whole deal started over a girl I never even touched. As for my attorney I did most of the work. My first judge was judge tan with a 97% conviction. I wanted to inhibit but was told I needed a valid reason. My attorney told me not to waste my time. I wrote it based on my right to a court with cokd neutrality. It was granted All I do is read about the law day and night. I am the only foreigner here, all my I gave to my lawyer. I am afraid they can't let me win. If the court set an investigator to the hotel they would know i sm innocent. Now it will be a long battle. My gf is working in Costa Rica. My life sucks. I am always hungry. I will win this case I don't know vif media would help.
