Any reason to buy a house or land ?

    I really planned myself (married with a Philipina and no plans to divorce) to buy a nice house on a nice lot in the Philippines. After reading this message, I wonder, is there really any good reason, for buying instead of renting ?

    CA:Aliens not allowed to acquire private land

    The Court of Appeals has affirmed the decision of the lower court that aliens are not allowed by law to acquire any private land in the Philippines, except through inheritance.

    Dumaguete City Regional Trial Court Branch 34 Judge Rosendo Bandal Jr. granted the dissolution of conjugal partnership of gains between Willem Beumer, a Dutch national and Avelina Amores, a Filipina, considering the fact that their marriage was previously annulled by RTC Branch 32.

    The six parcels of land that are the subject of the case were declared as paraphernal properties of Amores, because these real properties were acquired by onerous titles during their marital union.

    Beumer, being a foreigner, is not allowed by law to acquire private land in the Philippines, except through inheritance, the court said.

    Bandal’s decision further declared that personal properties, such as tools and equipment mentioned in the case amounting to P500,000 are co-owned by the Dutch man and the Filipina since these were acquired during their marital union, and since there is no prohibition on foreigners from owning buildings and residential units.

    In assailing Bandal’s decision before the CA, Beumer prayed for equity to be applied to him, but the CA said it is inapplicable and misplaced in the case.

    It noted that Beumer was aware of the prohibition against aliens acquiring lands in the Philippines under Section 14, Article XIV of the 1973 Constitution, and that, the properties in the case, were instead registered in the name of his Filipina wife, so Beumer can not seek reimbursement on the ground of equity, the CA decision said.

    Beumer had said the properties were purchased with his disability benefit from the Dutch government, but the Filipina wife contends it was her earnings that were used in purchasing the properties, court records said.*JG

    there is NO good reason, unless making your wife and her "pamily" happy counts for you as one and you don't need to look that much after your money.

    Special in a place like Duma which capabilities got totally overrun by the general development (and no Official in Negros is prepared for that). You might buy the best piece of Land around Dumaguete and in 2 years they start building a monster factory/mall/resort/callcenter. Right next to you.

    Just rent. the next lovely Island is just a boatride and a containerload away and safes you a lot of money and nerves.

    anyway there were some older threads like that before.

    Aliens in Dumaguete

    Alien registration card with an expiration date for documented Aliens in America.
    Illegal Aliens for undocumented folks who are living inside The US of A.
    TNT ( tago-ng-tago) for pinoys and pinays.

    Even in Japanese Government use the word Alien.

    So the question is, why do we call Aliens in Dumaguete, Foreigners? The locals are using these word 40 years ago during my grammar school days.

    I wonder why

    I've known Willy for over 20 years, it comes as no surprise that he lost the case, not only through the law as it currently stands, but also by his past behaviour.:rolleyes:
    If he had had his wits about him, when he got married, he and his wife could have signed a prenuptual agreement, whereupon, he could have had all the proceeds from the sale of the properties split 50-50, on the dissolution of the marriage.
    Now, whether you believe that a prenuptual agreement paper is worth the paper it's written on or not, it is still a legal, notarised document, signed by both parties, which will stand up in the Philippine court system.
    Life, and sometimes married life over here, isn't always "happily ever after". In my opinion, he should have known better, tough luck (but not really a surprise to a man who has been 'alledgedly' harmed(physically) by his other half on numerous occasions, in the past).

    Who is it for?

    NKIT as you can see the answer is probably no, Unless you have children that you want to inherit the house or land. It is much cheaper to rent. And as Roody mentions it is much easier to pack up and go to another area if find you no longer can stay in one place. :wink:

    Well, when I first came here, all 'wide eyes' were called 'Kano's or 'Merikano's, guess locals eventually found out that not all of us come from the 'Good Ole US of A'.:smile:
    There was a 'grammar school' here in Dumaguete, 40 years ago? Never heard of that. I learn something new, everyday.

    if there was it must be closed by now, or starts after college. I get frequently highly questionable expressions in job-applications... example (college graduate):

    "i like sports having with my friends and also i lke going in beach "

    sorry for being off - topic... it's about land and house...
