    This is a question that nobody can answer while so many factors will make the difference.
    About 90 % of all title transfers are problem cases.
    In fact you don’t need a lawyer, only a Notary and the rest you can do yourself.
    Lets start with the Capital Gains Tax (CGT) that the seller has to pay.
    CGT is 6 % of declared or fair market value and most sellers don’t want to pay it. You have about 1 month (depending date in deed of sale) to start the BIR procedure and get this CGT paid or pay a high fine.
    Who will pay and who will pay the eventually fine?
    Just in case everything goes smoothly, what do you need?
    -Original Deed of Sale
    -Original certified true copy of the Tax Declaration from Assessor - latest copy.
    -Owners duplicate copy or cert. true copy from Register of deeds and Xerox copy of the title (back to back)
    -Orig. cert. of improvements from Assessor’s office.
    -TIN of Seller and buyer.

    Note: the buyer don’t have to sign the deed of sale, so it is possible to buy property in the Philippines while you are abroad.

    Mario, I hope Tom can give you a reference on a good attorney. I used two different lawyers on two different house transactions and cannot recommend either one. As Firefly stated, you really only need a notary; not necessarily an attorney.

    Unfortunately, in the Philippines only a member of the Philippine bar can be a notary.

    If you only need a Notary, I can recommend Alex Icao.
    He is lawyer and notary, and I don’t know how to estimate him as a lawyer, but as a notary he charges a fair price.
    His father is also lawyer but not notary and they share the same office.
    His office is in the building next to (right side) emission test center Hi Point on San Jose street (around the corner of Du Ek Sam).

    anybody that needs a lawyer in such a corrupt country as this should know better than to ask for one. Or better still, make absolutely sure they won't need one in the first place or anyplace.
