Hi, Just wanted to ask some help. We are hoping to put our land on the market & just want to know what the regulations are if someone is currently using the land to work on. The land is in our name, the people farming on the land don't have any records whatsoever that they can work on the land, however there was apparently a word of mouth agreement from well over 80years that they can use the land to farm. What we want to know is if they are entitled to any of the portion of the money from the land if it sells (apparently Philippine law is different from anywhere else in the world). They haven't paid rent for using the land, but we've just been made aware that they have been giving some money to another relative of ours as we don't live in Dumaguete. Also how do we go about telling them that we no longer want them to farm there, after all it belongs to us. Thank you in advance for your help.
You have what's called a "tenant farmer", you will have to pay them to leave. It's just the way it is, good luck.
I agree with Manzanita. We had a similar issue a few years ago. We have hectares of land in Calinawan. A family had been squatting there for quite awhile for a number of years. Becasue of this, the barangay captain was involved and statements were taken and we had to negotiate in order to see them off. Witnesses if they were alive had to testify that the land is ours. Yes, the laws are different and yes, you just have to pay them to leave. There is no other way around it.
