im U.S citizen never been to duamaguete, arrived month ago with legal 2month U.S. daughter (baby has US Passport and i have original birth cert) - Girl im dating (not married), threatened to call PNP on me false accusation and have her cousin take away US baby if i dont comply to her every request..what to do in such case?
I think the best thing to do is to find a lawyer just in case things becomes rougher. Then, go to the nearest PNP office and report the threat. It is also better if you have the barangay captain on your side. I am a Filipina but laws regarding custody of children below 7 years old here in the Philippines can be very anti-alien. There have been circumstances that the baby is used by the mother (backed up by DSWD (Dept of Social Welfare and Development) as the means to siphon money from the foreigner. Where are you located? Maybe I can call someone to assist you.
Suggest you and baby get on the bus, Gus, let things cool down. Sounds like someone is out for money, and the police might just help them get it!
If the GF is Filipino and the baby's mother, the baby is also Filipino, and under Philippine laws and jurisdiction while in the Philippines. Under Philippine law, you have absolutely no legal right to keep the baby from it's Mother. Children under 7 years of age are automatically deemed under the care and authority of the mother. Tread softly. Larry
If the girl is not the mother, and the mother is not in the Philippines, p*ss off back to the US or get to an Embassy ASAP. I have a feeling you are withholding some information here and there is much more to the story as anyone with a bit of sense would have done this and not wasted the time posting here.
I can't think of too many reasons why an American would bring a 2 month old to the Philippines. First thing I noticed was that he did not mention he was the father or caretaker, only that but the child was "legal". I couldn't imagine that on a first trip to a foreign country, and a 3rd world one at that, you would bring a child that young. Something is very off here. Any American having their child threatened to be taken away illegally would go straight to the police or embassy......unless they were doing something shady in the first place. My questions: 1. Legal guardians: Is it you? If not: Where are they? What are their nationalities? Do they have family in the Philippines? 2. What is your relationship to the guardians? 3. Why was the child brought to the Philippines in the first place? 4. Where was the child born? 5. Is the child a dual citizen? Filipino American? 6. Where did you meet this girl you are with? 7. Why did you choose Dumaguete to visit? That's just a start but should help any members answer how you should go about getting help.
