Hi I am new here & have been trying to find similar posts to what I will be posting now but have found none. So here it goes! I am a US Citizen, born & raised in Dumaguete and is now planning to apply for the Dual Citizenship. I will be marrying my Filipino boyfriend soon & have started to check with the requirements. One requirement is the "Legal Capacity to Contract Marriage". Since I will soon be a dual citizen, do I still need to go to the US Consulate at Cebu & attain this document or can I just get my marriage license under my Philippine citizenship? And if not, will this affect my application when I plan to bring my then-to-be-husband to the US using the Spouse Visa? I really do hope someone has an answer here. And may I ask, if they do still require the Legal Capacity to Contract Marriage, should I also provide the "CENOMAR"? I really hope any of you can answer my question. And if anyone is willing may you enlighten me on the whole marriage application process for a US Citizen? I would really be delighted if you can help me. My boyfriend & I will just be having a civil wedding at my family's beach house at Dauin. THANK YOU ALL!
You do not need to obtain the legal capacity document, you are Filipino first and foremost. The reaquisition of Philippine citizenship under RA9225 is easy and cheap (better to do in the US). There is no reason that the LCR needs to know you are also a US citizen, just present them with your NSO birth certificate and a local address. Yes, you will need a CENOMAR. No, it will not effect the spousal visa for your husband. Here is an article about marrying in the Philippines as applies to a US citizen (non Filipino); Getting Married in the Philippines Larry
Thank you so much! Yes I will be applying for Dual Citizenship here in Chicago next week. THANK YOU AGAIN!
