Yes that has happened on occasions. Depends on the amount of force used at the time, which is ridiculous as in the spur of the moment you're literally fighting for your life, perceived or otherwise. A UK farmer shot someone a while back breaking into his farm house and was sent to prison if I recall. They had broken in before but this time he was tooled up and ready. Law said he used excessive force. As for the image above, lesson learnt hopefully...
