    Capacity to Marry

    But hold on there. That will not be the end of it as you might have thought in a previous life. Hang on to whatever documentation you produced at the consulate. You will need it again.

    In this land of perfect bureaucracy, at least here in Dumaguete, you will need both the Certificate of Capacity AND the documentation which you produced to obtain that to the helpful folks at City Hall in order to apply for your licence.

    It can be done.

    You have to be creative but it can be done. For instance if you have never been married then statements from your priest or paster and a relative or two attesting to that fact go a long way. Same with divorces or deaths, you just need to have all of the certified paperwork with you.

    You needed to talk to a different judge. ANY Judge can marry you if they want to.

    :confused: If you have had a previous Marriage there are very few Churches that will marry you, it has to be a Civil Wedding, Either Hall of Justice or Hotel , Garden, your choice, It can only be a Judge that Performs this as outside a Church is a Legal ceremony. When you Purchase your Marriage Contract ( And you will need ALL those Documents again ) your name will go to a Lottery for allocation to a Circuit Judge. That's when the little problems can Start as it is then, they can decide if they want to do it or not. I assure you that The Hall of Justice is the Place to get any information on marriage as this is where you get the marriage Contract from.:smile: I am looking for the Time scale table from my wedding and will post it later as it was quite an ordeal:(

    How you Marry depends on where you are and who u talk to. I was married by our Mayor in Compostela Cebu, the church refused because I'm not Catholic. My friend was Married by a judge in northern Cebu and a Canadian friend will be married in 2 weeks also in Cebu by a Judge.

    But just because they do it in Cebu, doesn't mean it's always the same in Dumaguete or any other part of the Philippines.

    Just my 2 centavos.

    This is the first I have heard of any "lottery". Any Judge (or even a ship's captain) can marry two persons with a marriage license. It does not have to be in the municipality where the marriage license was issued.

    When we were ready to marry, we talked to several local Judges, who all agreed to perform the wedding in chambers. Neither of us wanted to get married in a Judge's chambers. It was a first wedding for both of us.

    We found a judge who married us on the beach in Sibulan. Our marriage license was issued in Dumaguete. Yes, she did it even though we had an "affidavit in lieu", and our marriage is just as legal as anyone's.

    Yes my experiences is pretty much the same as Jack P. and Larry. When we were married it was my first time, I was a confirmed batchlor untill that day. Haa Haa. The only differance is We were married by a Mayor in his office. It was ok, and no lottery at that time just an appointment.

    :smile: Quite right Larry! I was really just commenting on the Judge issue. Now I have found what I was looking for I will Post what for me, was a traumatic time in 2008. Although Cory and I have been to gether for many years, It was, we thought, time to get legal as I was coming to retirement.
    I am going to have a coulpe of SMB's and sit and write my little story, Those that don't want to read it, sorry if I take your time up. It may help a few others here, realise that all is not equal and there are most definatley some Pifalls.

    According to Philippine Law a Judge can NOT perfom a wedding ceremony of an American because the Certificate of Legal Capacity is in Leu of. That document is not accepted. Talk to any judge and let him read it to you from the Law Book. Also problem with the Catholic Churc if you are not a Catholic.... The Judge told me that he don't mind to wed us, but the problem is the Filipino Law. Hope this info is clear and understandable.
