    Or maybe this is the correct rule:


    Primary – legitimate children and/or descendants
    Secondary – legitimate parents and/or descendants; illegitimate parents
    Concurring – surviving spouse; illegitimate children and/or descendants

    Or maybe it all wrong. lol

    :confused: FV, as I said, it all gets so very confusing. As I am some 18 years older than Azon, at 62 I don't think I shall have much Worrying to do :eek:

    The Torrens Title

    Or to make things even more clear-- LOL you got to require the Torrens title. lol:D

    Ownership of real estate in the Philippines is determined by the Torrens title.
    One of the cardinal principles in the Philippines is the indefeasibility of the Torrens Title to determine the ownership of real property. The registered owner indicated on the Torrens Title, and the incidents annotated therein, generally defeat any other claim, or claimant, not so registered. The Torrens Title system is quite reliable and has been used effectively to defeat the claims of some unscrupulous Filipinos who attempt to acquire other people’s real estate in the Philippines by means of spurious or fake titles. A foreigner who purchases or inherits real property in the Philippines is therefore strongly advised to avoid such problems by procuring the services of a local lawyer to ensure that his/her name is registered as the legal owner on the Torrens Title.

    A foreigner may, if the circumstances are right, inherit land in the event his wife dies. There may (as in most likely) be other claims to the land also. A foreigner may also own land that he/she purchased prior to 1935. However, most of this is probably pretty useless information to the original poster.

    A foreigner cannot have his name on the "torrens title" except as the "married to", unless he/she obtained the land in one of the two methods here-in discussed.

    Hi larry, I agree with both parts of your post, I already have 1 claim against the Lot, that's Ok as it is the daughter, as you say not really going to help the OP at this stage as you say.
    I sat this morning and read all the documents about the land, You are quite correct in that the only mention of me, is that Azon is legally married to me, my full name, nationality, age and confirmation of my residence here. This my Lawyer tells me, is about the only confirmation I can expect with regard to my existence at all. It will help however, should the unfortunate passing of Azon prior to me, in staking a claim to the land. Not a thought I wish to even think about. I hope that the OP can draw some prospective from these posts.
    I have said all along, the issue is very complex and totally confusing. :eek: Glad you are around to help us unwrangle things when needed.:wink:
