Had a few problems with some land infront of my property over the last few days,i showed an interest in buying it if it had a clean title and turning it into a parking lot and garden area. After showing up at the sellers lawyer yesterday i find out that there is no deed to show and also after hearing many rumours from neighbors etc i decided enough was enough and told the seller i was not interested any more. Next thing is the land is being cleared and a new fence going up which now makes it much more difficult for me to access my parking onto my property,luckily enough i can still get in. Just a word of warning to everyone just to be careful when buying!!!!
Having a clear written (or typed) copy of a title is not at all common! Why? Because the Philippine government takes YEARS to process a title change! An "owner" may have a copy of "A" title, been paying property tax on "their" property for years, but their name might not even be on the title for the reason stated above. One can research the title but it takes some talent and is time consuming. I have a friend who recently bought numerous pieces of bank foreclosed properties from the bank, and even the bank did not have the correct titles! His solution? Pay 1/2 down, and the other 1/2 upon receipt of the correct title. Buyer beware!
If you are the owner of a lot you should have a tittle. Even it can take long to transfer a tittle in your name, the old tittle only has to be returned to the registry of deeds the moment the new tittle is produced No tittle (not a copy) = trouble
Its so frustrating that this is the case. We've bought our lot, got the deed of sale & still after long 6 yrs, we're still waiting for the LAND TITLE transfered to my name. I happened to meet & spoke to our Attorney- January 2011, and he shoke hands to my husband & promised the title will be ready by February or March this year & still we are agonisingly waiting. What hurts most is that we've already paid fully & the Atty's fee as well- That was the BIGGEST MISTAKE:(((
I guess we were fortunate. Last year we bought our lot in May and received the title changed to my wife's name in Sept. We made numerous trips to BIR and many more to ROD to try and escalate the process. It helped.
For everyone planning to buy properties here in the philippines.... be very careful in buying real properties. Always bear in mind "BUYERS BEWARE" . talk to the right lawyer and listen to their sound advice. its just a matter of finding the right lawyer. I recommend Atty. clean titles If you need real estate paperwork checked to see if it's legal, e-mail Shadow or Larry. He knows the ins and outs of the land buying minefield here. I used him and am well satisfied, as are my friends who I directed to use his services. For checking paperwork you don't need a lawyer and Shadow is cheaper and through. Using his advice I walked away from a land deal and learned a lot in the process.
