15yrs in jail, opps mistake go home

    Yesterday Hubert Webb along with 5 others had their sentences overturned for a murders that happened more than 15 yrs ago here.

    Briefly, this Hubert Webb wasn't even in the country, he was in the US at the time the murders happened.

    A witnesses evidence was given more credibility than passport stamps, and letters from the US government, confirming his location.

    Yesterday the Philippine Supreme Court said the witness was in fact an NBI agent, and not a witness.

    But Hey, he wasn't even in the country at the time.

    15 yrs in jail, that's a long time to review the court sentences.

    Webb in the US

    The High Court also believed Webb’s alibi that he was in the US when the crime was committed on June 29, 1991, saying documents supported his claim.

    “Alfaro’s quality as a witness and her inconsistent, if not inherently unbelievable, testimony cannot be the positive identification that jurisprudence acknowledges as sufficient to jettison a denial and an alibi,” it stressed.

    The SC ruled that the documents submitted by Webb’s lawyers during the trial, including two immigration checks showing he left for San Francisco in California on March 9, 1991 and returned to the country on Oct. 26, 1992, were authentic.

    “The prosecution did not bother to present evidence to impeach the entries in Webb’s passport and the certifications of the Philippine and US immigration services regarding his travel to the US and back. The prosecution’s rebuttal evidence of the fear of the unknown (was) planted in the lower court’s minds,” the SC added.

    What about the other 5

    Ok, Hubert Web wasn't in the country or maybe he was, passport stamps and records are easy enough with enough money.. But what about the other 5 co-accused..??? Seems the money thing worked there also..

    Andiflip,

    Your comments are quite common in relation to this. Perhaps some American could answer how easy it is.

    If the family had that much influence how come Hubert Webb and the others spent 15 yrs in jail.

    What you also need to understand is that the 7 spent time in jail as the result of the testimony of one person. Any other evidence was given little or no credibility, like fingerprints.
