I wouldnt worry about it if I were you. Seems to me you are getting your knickers in a twist over something that probably wont happen.

Looking close at the photo, looks like the shield attaches to the axle bolt of the rear wheel. The nut to the axle is usually tightened to 50 to 60 ft pounds of torque. Will the long leverage of the shield frame overcome and tilt back pushing against the rear rider on hard acceleration? I'll just guess they considered that. Or maybe I'm just missing something. Hard to tell from the photo...maybe there's a support bracket to the bike frame near the axle?
