    Need some advice please what are the restrictions for a foreigner( irish) in purchasing land I been offered some in North Cotabato which is under rubber plantation i been there many times and i know the sale is geniune title deed etc
    any advice welcomed

    :( In a word Ruanard, NO! you can't purchase and own land in the PI, All us married Foriengers, that have our own houses, have built on land owned by our Spouses or their family. There are a lot of posts recently on this very Subject. Shadow presented a comprehesive post on land ownership and its implecations, it is a very comlpex issue but Marriage/Engagement is the Only way. Of Course there are ways with partners but be very aware of the problems in this Avenue. Maybe a PM to him will Yeald some better answers than I can Provide. I will say though, that, after this reply you may have the Anti-brigade giving you all the Bad points, There are a lot if you choose partners but a few will try and poison your mind with bad wives tales.     Not to mention that North Cotabato is on Mindanao. Not a place for a foreigner to be roaming around the countryside.

    Some of the problems there are a result of outsiders buying up Muslim land. Muslims traditionally never titled their land. How such lands are obtained from the Muslims may be part of the problem as well.

    Buy some land that was less than legally acquired from its owner and you're asking for trouble.

    As a foreigner you cannot own land. If you are married to a Filipino and secure in your relationship your wife can own land. You can form a corporation, and be 40% owner of that corporation. There must be 4 Filipinos in the corp, none of which can be your spouse or offspring. Just be careful not to fall afoul of the anti dummy law, but under your circumstances the corp will be set up for the purpose of a plantation, not just as a dummy in order to own land, so you should be ok there. There are tons of unscrupulous lawyers, and their victims, who will try to set up various ways of getting around the law, but don't get taken in by them. EVERY loophole has long been tried and closed.

    You can lease land for 25 years, extendable for another 25 years upon both parties in agreement at the time of extension. You cannot lease from your spouse.

    We spent most of this week in South Cotobato, not a place I would consider living or investing in.

    Owning land rules--

    Hi there, this is not all correct. You can as a foreigner own land in the Philippines. Under two circumstances: If you purchased the land before 1935.
    And second: If your wife dies, you can legally inherit the land from her. Even if you're a foreigner. This is correct I belive. Pls. let me know if it is wrong
    Hmm, both the scenarios seems a little out of reach-- unless--:D

    :eek:FV, not sure that any of us here on DI, are old enough to have bought any land prior to 1935, We have just bought a lot and one thing I was told was that, my Filipino Daughter will have precedence over me to ownership. The only way a Foreigners is going to get the land on the passing of the spouse is if, they marry an orphan, then watch the hidden family come out of the wood work like it was New Years eve. :D Whilst I can appreciate your comments, The ownership issue is too complex and I do not think this will serve Ruanards need for an answer. :wink:

    What if one's wife has no kids. Then surly the husband inherits the land if the wife passes away :confused:
