REPUBLIC ACT NO. 10054
AN ACT MANDATING ALL MOTORCYCLE RIDERS TO WEAR STANDARD PROTECTIVE MOTORCYCLE HELMETS WHILE DRIVING AND PROVIDING PENALTIES THEREFOR
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
Section 1. Short Title. - This Act shall be known as the "Motorcycle Helmet Act of 2009".
Section 2. Declaration of Policy. - It is hereby declared the policy of the State to secure and safeguard its citizenry, particularly the operators or drivers of motorcycles and their passengers, from the ruinous and extremely injurious effects of fatal or life threatening accidents and crashes. Towards this end, it shall pursue a more proactive and preventive approach to secure the safety of motorists, their passengers and pedestrians at all times through the mandatory enforcement of the use of standard protective motorcycle helmet.
Section 3. Mandatory Use of Motorcycle Helmets. - All motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway.
Standard protective motorcycle helmets are appropriate types of helmets for motorcycle riders that comply with the specifications issued by the Department of Trade and Industry (DTI).
The DTI shall issue guidelines, which should include the specifications regarding standard protective motorcycle helmets.
Section 4. Exemption. - Drivers of tricycles shall be exempted from complying with the mandatory wearing of motorcycle helmets as provided in this Act.
Section 5. Provision of Motorcycle Helmets. - A new motorcycle helmet which bears the Philippine Standard (PS) mark or Import Commodity Clearance (ICC) of the Bureau of Product Standards (BPS) and complies with the standards set by the BPS shall be made available by every seller and/or dealer every time a new motorcycle unit is purchased and which the purchaser may buy at bis option. Failure to comply with the requirements provided under this section shall constitute a violation of this Act.

in the process of refining this republic act, several developments have already transpired, and you should also have a copy of those developments (meeting minutes, implementing rules and regulations or IRRs, etc) to get the whole picture as it is at present. heck even the Sept 30 limit for keeping the stickers free of charge has been fought for! but to sum it up dti wants their stickers on the helmets. period.

there's an easy way out actually, buy a new helmet. no lines, no waiting, no hassles.

thats dti haha department of trade and industry, interested in the continuous flow of trade in the country. by the looks of it they really dont care about safety, drop by unitop and rusi, they sell very cheap helmets with the ICC stickers already there! driving within the city perhaps that's ok, but hitting speeds starting 80? its your HEAD literally at risk! lol

Does anyone have any idea exactly WHAT these guidelines are?

While at DTI today, there was a woman there with a similar helmet to the one my wife has, which came with an ICC sticker. She told us that it was only good for a backrider, not a driver of a motorcycle.

I assume this means that since the driver of the motorcycle is in front, that by Philippine law he/she MUST be going faster than the passenger, and therefore needs a better helmet than his/her passenger which is obviously going slower because they are behind the driver?

How about the 2 kids in front of the driver? any regulations for them ?

 

No rules for them yet, that will probably be at the discretion of the LTO Officer - great source of income !!!

So we're nearly there with rules for the driver and rules for the back-rider, but no regulations for the one in the middle. I guess they also havn't given much thought to the kid sitting on the fuel tank, the driver swerving about because he's only got one hand on the throttle, the other hand is busy texting, and his pregnant wife balanced behind him, with a kid under one arm and her shopping under the other, and all the while riding side-saddle. An ICC sticker on this guys forehead is really going to make him feel bomb proof.

 

larry that's one of the problems even in metro manila itself. there was a reported case of a helmet that passed in one dti office but has been rejected in another even when the helmet had an international safety standard sticker. reason for the reject is that the helmet brand was not in the list. click here

looking at the guidelines will help little because the guys in the offices keep on changing them and not alerting everyone concerned fast enough, if not following them properly. chances are we will be looking at an obsolete list somewhere found in the internet.

 

Unfortunately they are considered expendable air bags......

 

broadside, exactly my fear. the riding public dont know the rules in full and dont lift a finger to find out or just depend on the word being passed around. so how could they ever have a proper defence when flagged in the street? they can't, they just conform to what the apprehending officer charges them with. but what i like with our officers is - just dont be arrogant in front of them - they aren't like the ones in cebu and manila.


regarding number of persons on a motorcycle, strictly speaking, only the operator and one passenger is legally allowed on any motorcycle and they should both have ICC helmets on.


street-level apprehension by the lto will be the standard drivers license, vehicle registration, vehicle operability, and now the helmet with ICC check. the prior item alone gets their hands full!
