    :smile: I thought about this for some time, not wanting to tread on any toes, not wanting to take anything away from OP's Posts and not wanting to confuse any issues on other threads, I decided to start a new thread about Purchase of land as a Foreigner. I know, we all know, that I can't own land in the PI at this time, That is not the reason I write here. I write to illustrate how easy, problem free it can be if we just follow the rules of the PI, listen and act on advice, Help and using the family to the Full. I am sure you are all aware that, I have this thought of total integration and still believe it is the way forward. It will always be her land but I will say we, as we are of the opinion that whatever we do, it is as a family This story started in early January, we had been to Pat O's house. We had had some meets and had some good laughs and talks, On the 16th of January at the House blessing, Azon and Crislyn had Girly chats as our sweeties do, the party over, we had been home some 2/3 hours when she decided we should go for a walk, mmmm I thought, what now? Long story short, she and the Monster had been talking about things and Azon had been talking about Pats house and how nice it would be to have the sort of privacy that you can only get in your own house.
    Over the next few days it came up that maybe we should move on and live away from the family, So, we duly sent messages out to the family, we wanted to buy a Lot, we were offered 3/4 and duly went to see them. We saw one belonging to an Aunt of Azons high School friend. 500 meters in Junob, Good price and a corner lot with right of way on 2 sides. here is the schedule of events.
    Thursday 21st, get site approved plan and copy title.
    Friday 22nd, get clean bill from land registry.
    Monday 25th get copy of DAR clearance ( AG Land)
    Thursday 28th get news money owed to City Hall 2.500php
    Friday 29th. City tax paid OR received. Right of way conformed.
    Monday 1st Feb confirmation that Capitol Gains Tax and House tax Paid for 2010.
    Tuesday 2nd meet lawyers to compile deed of sale.
    Wednesday 3rd a few problems with husband of buyer, in Saudi.
    Monday 8th, No problem, received affidavit of permission to sell. Noreco and Water supply confirmed.
    Tuesday 9th, Deed of sale goes to notary for notarizing.( payment made at this time) can't Notarize as Azon forgot here ID:mad:
    Wednesday 10th, new DAR Clearance issued.
    Thursday 11th February. Duly Notarized, We have bought a Lot,:D Land Registry Done, City Planners registered, lot now in the process of BIR and Absolute Transfer registration.

    Moral of this is , as we have all said at some stage, go armed with the right papers, ask the right Questions, be aware of any foreseeable problems, Check and double check all details it can be done. Total time from saying YES! to owning 21 days (including weekends and 1 or 2 hiccups.) +Azon has family and fiends in the Majority of offices concerned and this I know helped a lot. That's real integration for you.:wink: just thought I would share this so maybe New comers can see or even those sceptcal members can see it can and does work :o

    My wife and myself had the same experience back in the late 70's, when we purchased a building block in Dumaguete and a farm . Only thing that can cause a problem, is buying land without a waiver from all family members that may be able to inherit when the original owner dies, but now big problem if done at time of sale. Best of luck with the construction.

    This is a remarkable story Jack but it is simply not true.
    You own the land when you have the tittle and that is still going to take a few months if nothing goes wrong.
    I hope you have the original tittle, you never mention it, and untill now you could do with a xerox.
    After you get the bundle of papers back from BIR, you must go to Registry of deeds and surrender the original tittle. No tittle - big problem.
    It still takes about 6 weeks to produce the new tittle.

    Doubts! None!

    January 21st get approved site Plan, copy of Title Deed.

    February 11th Sale Duly Notarized, All papers now with B.I.R.

    No incumbents, so we will see how long it takes. We worry Not.

    Purely an illustration of sometimes things, can get done quickly that's all.

    A friend here in Cebu bought (I say he bought because it was his money) a place from a Chinese owned subdivision here in Yati area.
    One year after the land was paid for, house built and all were settled into the home, no title/land deed.
    They had to hire an attorney to force the Chinaman to release the Title and within three years of paying him, they finally got their title, but it cost them an extra P40,000 for legal services.

    Confused: What do you mean by "surrendering the title to the RoD"? Maybe you are stating to surrender the original title for the land you just purchased that is in the seller's name then in due time you will receive the original title in your spouse's name. That process took us over 4 months and that was with weekly follow ups to the RoD office and some gifts.

    That is correct PatO.
    During the whole process nobody is asking for the real tittle of the seller.
    You are supposed to receive that tittle the moment you pay for it and the seller signs the deed of sale.
    Signature of the buyer is even not needed on the deed of sale, that means that a trusted person can handle the transfer of tittle for someone else.
    Only the moment that you bring all the paperwork to registry of deeds you must bring the original tittle from the seller as well in order the be able to get a new tittle.
    Before the tittle was red with yellowish center, now the red is replaced by blue and the text that was almost unpossible to understand is now short and only the most important items are there.
    And at last it is computerised, so if corruption was not part of the game it could be done in less than 1 week.

    Firefly, Thank you for your concern re; Original Title. We do in fact have it, Azon received it when she paid for the Lot and signed the deed of sale. It was the one thing, that did not go to the BIR. :wink: They have a notarized copy.

    :D Sometimes we have a One Horse race, Then on the other hand we have an outsider that comes in at 100- to 1, Me! I will put money on either :rolleyes: Enough said I think!!
