    Dustin, Today at the mall Kojak handed out to foreigners he saw there a printout from the Yap thread from the barrio with posts made by forum moments directed at him and his rebuttal. More on the story was posted on the barrio before the shutdown.

    Yeah, that's pretty messed up. That totally goes against what the Barrio was meant for. It endangers members and breaches the trust of the forum. Yikes.

    Not only that, it's just lazy. If you want to distribute something, rewrite it to make it your own words and attach your own name to it.

    So much for the barrio being a safe place to post. I would understand if it didn't open back up. If it did, I would certainly be much more cautious in what I posted there in the future.

    This would probably require a bit of development, but there are a couple more things you could do to provide some of the features with less potential for problems.

    Allow members to create their own areas for discussion and give out invites to those areas. Then members could police their own discussions. Of course, they could do this elsewhere as well. No need to have DI stick its neck on the line for these conversations. Private messages might get you close enough to this feature also.

    Have the forum posts in the barrio self destruct after X hours.

    Personally, I would have the website based in the US and not gave two shits about Philippine libel/defamation laws. I'm not 100 percent sure, but I'm going to say that no US law enforcement will be delivering a subpoena for IP addresses issued by the Philippine government.

    And I would like to set something straight concerning this defamation law. Saying that the statement is true IS a defense. It's the nature and intent of the comment that matters. If you say it out of spite then it doesn't matter if it is true or not, you are trying to harm that persons reputation. If it is said with good motives then there is nothing they can do to you. So it's not so much what you say but how you say it. Of course that is in theory, the verdict will go to the person with the most bribe money/powerful contacts. I didn't read all of the below link so I'm not sure if there is an "opinion clause" to the Philippine law....I highly doubt there is though.

    Truth doesn't matter, intent is everything.

    Don't accuse a government official of being a "thief" or "robbing the poor"...unless they were arrested, convicted and booted from office.

There is malice when the author of the imputation is prompted by personal ill-will or spite and speaks not in response to duty but merely to injure the reputation of the person who claims to have been defamed. Truth then is not a defense, unless it is shown that the matter charged as libelous was made with good motives and for justifiable ends.

    Personally, I think that calling out certain people for their general defamatory comments would not constitute libel. But that's just me. I'm sure a decision would likely be rendered solely on who gave the biggest bribe.

    A certain member, was already banned from the Forum and has been, for quite some time,

    It may well be possible, they were back under an AKA and had ready access, to the Barrio (you know to keep up on things)

    Then again, maybe, we have a member, who has laid low, for some time and only raised a head, when all this started.

    One and the same ???:confused:

    Strange thing happen, I was thinking of this thread and the possibility that it may get compromised and I was thinking about having the threads "burn" after 2-3 days so to clear up the space in the activity stream and not to leave a history of our ramblings, to late now...
