In the US divorce/dissolution of marriage is a state by state thing. He would need to contact a lawyer in the state he plans on getting a divorce in. Side note: Some states don't even require you to serve divorce papers in person if the person is being difficult to serve. "Motion to Serve by Publication or Posting"...if the spouse can't be found you could serve them through a local newspaper. Welcome to LawHelp.org/DC | A guide to free and low-cost legal aid and services in Washington, D.C. You could also get a fault divorce for abandonment/desertion. In the US you can go to Nevada and file there if a US citizen and after 30 days residency can file. You do a no fault divorce through a paralegal rather then more expensive lawyer. Takes a bit of play on details but in the end the objective is accomplished legally. Cost me about $1k to do that plus the stay and needed a 90 day residency but 30 days gets you an ID to file and just work it from there. But then you have to do extra crap to file a *recognition of foreign divorce* which requires your divorce papers be recognized by the US Sec. of State and then acknowledged by the Philippine Embassy there which can be done through another kind of guy there for a fee. After that file that here with an attorney which goes to court and if all good it gets ready to file at NSO. However sometimes the judges here being corrupt POS's delay or stop it under BS excuses because they are religious and dislike even though its beyond their authority unless they find your divorce isn't legal in your home country. This crap happened to me simply because my case went to a religious nut public opposition attorney who tries to find whatever BS excuses he has to get the judge to dismiss it (BS excuse was that I was married in a different city although that doesn't matter) and I had to get it appealed which is another nightmare. Best option, just get a divorce abroad and screw ever getting married here again.
