Law enforcement agencies are now empowered under the new law to conduct field sobriety, chemical, and confirmatory tests.

If the driver fails, and if the law enforcement officer feels that there is any indication that the driver is under the influence of the relevant substances, the officer may ask the driver to undertake a sobriety test.

If the law enforcement officer also feels that the driver has failed a sobriety test, he can be subjected to the use of a "breathalyzer" to determine the alcoholic content of his/her body at that particular time.

It looks as though "under the influence" is up to the officers opinion, but a breathalyzer test will confirm whether his opinion is correct or false.

Caution to those who like fresh breath and mouthwash!

I as yet do not live in the Philippines, I did at one time many years ago live there, and at that time I did routinely drink and drive (stupid but at least I was alone and on a motorcycle, I would have been the most likely to be hurt). While I lived there I could afford things I never could before or since like a maid, today I have to ask why anyone would not hire a driver, or at least a maid or houseboy that could drive them?

How will they determine if someone is driving drunk?? Swerving in and out of traffic? Failure to yield? Not stopping when one should? Sudden erratic stops? Not stopping for pedestrians? I am really confused as to just exactly how they will determine if someone is actually driving drunk when everyone here appears to be drunk while driving!! Would be nice if they actually enforced a mandatory driver's learning course, that included actual rules of the road and laws that were actually enforced, before issuance of driver's licenses!!

For me, I would rather take my chances drinking and driving than hire a maid or houseboy to drive me. Once you are here and see how the locals drive, you may agree with me.

A maid or houseboy as a driver? No. A professional driver that is good at it? Yes. On occasion I've used the later and have been very impressed. I would not even consider using the former.

Recently, law enforcement is cracking down on motor vehicle drivers who are suspected of driving under the influence of Alcohol or Drugs and also who do not pass their roadside test routinely. The penalties and punishments may vary from state to state. All drunken driving offenses have maximum of jail sentence. But, for the first offenders it is only lesser punishments like Fines, driving license being cancelled, Mandatory attendance of AA meetings and driver’s education classes etc. After this an “ignition interlock” device will be installed in the vehicle for the driver requires passing a Breath Test in order to start ignition. This is only for the first time offenders. If they have been found again for a drunken driving offense, the result is DUI conviction.
hence drinking and driving is hazardous to the people and the person who drive..

That'd just be a business opportunity here. You'd have the parking boys charging 10 pesos a blow to start your engine. (*insert jokes here*)
