    These all would speak against any lot leasing. There is nothing mentioned that the land owner have to pay back any expenses the lessee did on the lot or the lessees already paid leasing cost.

    I was told if I leased and the Owner retook possession of their land via the 'personal need' clause I could kiss my money goodbye as you will not get blood from a stone! It WAS an option if we could not make progress on our problem we are currently experiencing, not anymore, now it is full speed ahead get out of my way! :punch:

    It took me less than a month to complete land sub divisions in the states. I realize it takes longer to get things done here. However Attorney Dorado should not have told me it would take 3 months to complete. After 6 months he now tells me it could take a year or more. WTF. Apparently you do not know the other forum member who posted about his problem concerning lack of research of clear title and having to hire another Attorney to fix the problem he created. I don't know about you, but that is definitely not my definition of a good Attorney.

    Having personally been through the subdivision experience, but not with Atty Dorado, I can tell you they can take quite some time. Mine was a year plus. The time to complete can vary quite a bit. You need to get all taxes up to date, all interested parties to sign off and then you need to work with several agencies. In addition, I was unfortunate enough to be doing this when titles were going from paper to electronic form. It's been a while, so I don't remember all the details other than being frustrated. If you actively manage the process (pay bribes and sweet talk employees) you can move things a lot quicker. If you just fill out the paper work and drop it off, it's a bit like playing the lottery. I'll go out on a limb and guess that most lawyers aren't that hands on with the process, hence the variance in time. Mine was started with a lawyer and completed by a non-lawyer who knew the in and outs of the process. If you want his name, let me know.

    At the risk of sounding like I might be defending an attorney...We have had a property for subdivision in Siquijor for more than a year and half. The attorney sent it in to DENR and it is now in their bottomless hole. My wife's cousin works for DENR in Cebu and even she can't get the thing pushed through. So don't shoot the lawyer.......on second thought.....

    Okay better update what I read on the Phil.gov Web Page regarding Leasing as per my previous Post: The Lessor can also Repossess the Leased Land & Evict the Tenant if he needs the Land for his or his Family's Personal use.

    A contract is a standing agreement that MUST be upheld! So if it is for one year or ten or twenty-five, the time period stated on the Contract MUST be honoured, and despite the wording read as it sounds from the Web site, my Attorney today explained in great depth WHY it is safe to Lease as long as it is done using a reputable Attorney to draw up the Contract. Nowadays nothing is going to be done without the say so of this team who has been with me now the past year or so and have helped and given great advice and are showing results! And yes; say what you will about trusting Attorneys, I do trust this Team who debate with one another before making a final decision and fully explaining every detail and step by step blow to the Client. Time will tell if I am a Fool who is too trusting, or someone who has finally woken up seen the light and who learnt to stop trusting others with a deal too good to be true! :biggrin:
