My understanding is this law applies to new applicants and renewals. I smell a rat and wonder if they are attempting to eliminate permanent resident status for expats by imposing impossible rules and then later discontinue Balikbayan status to foreigners married to Filipinas in order to place all foreigners into visitor visa status and cash in on visitor visa extension fees.
I think I understand their reasoning (that is SCARY!!!!). As others have said, it is to eliminate/dispose of undesirables. Those people that have violent/drug related/sex crime felonies on their record and are trying to escape their past. I think it's a good idea, but it sure would have helpful to those of us that are just regular law-abiding folks if they had put some procedures in place locally to help us abide by this ruling easier....after all, if we have to return to our home country to get this and we are gone for a month or more, how much money are they losing in their local economies by the absence of that income....granted, it's not like we are all going to go at one time, but still.... :( (I have a feeling that channelers companies will be setup to handle this for us at a high fee, of course)
It gets funnier, if you leave the country after its time for your annual renewal and you cant do it until you get your police clearance, I would not be surprised if you lose your permanent residency right there.
There are so many questions. Even though I haven't lived in California for over 25 years, that is the "Place of Birth" on my Passport. Should I just go to the FBI office in SanFran and get an FBI clearance letter, head to the Phil consulate in SanFran and be done with it? Do I really have to go back to the last state I lived in (That I am not longer a resident of) to accomplish this? If so, then I have to travel to Chicago to the Phil consulate there. FBI is FBI, they cover all states..it shouldn't matter...but...(it's more fun in the Philippines!) (My wife says...screw em...get a Balikbayan visa, take a vaca to Thailand or Bali once a year and get another one upon return) ha ha (Everyone has an ulterior motive..she's been talking about going to Bali ever since I met her)
I am just curious but what if your residency card expires while going through the process, are you allowed to leave The Philippines and or would that trigger fines from immigration?
Earlier if you left the country with expired card you give up your residency... Not sure if that is still the case, but it probably is...
I have a friend that went through this exact scenario...he waited a liitle too long to take care of business. he left for the states ten days before his ACR card tax(fee) was due and he was gone longer than he thought he would be. He had to start over and he had a lot of explaining to do...and of course that all had to be done in writing, notorized (which costs money). He finally reestablished his residency, but it cost quite a bit..as in start over with the extended tourist visa, then ACR, then 13a temp residency and wait a year to get permanent. Basically, he was lazy and stupid. He didn't pay the yearly tax(fee) and they canceled his ACR & RP while he was gone. He got quite a surprise when he returned and was issued a 21 day tourist visa upon entry. I know another man that the BI sent him a letter requesting a verification of address (this had to be done in person at BI at Intramouros). He lived in Davao and he just blew it off. They canceled his ACR & RP and he found himself in the country illegally. He had a lots of hoops to jump through to get it all straightened out.
I moved to a new place and just thought the annual report was enough for address change... When I submitted the papers to get a new ACR Icard I got same letter and had to go to Intramouros... I have moved again recently and I asked Immigration in my new location if I could register my new address, they said not until I need new ACR Icard... Go figure...
mmmmmmmmmm well now, I can understand. I think My 13a Permanent resident Visa, was issued by the Philippine Embassy in Madrid Spain in March 2009, there was never any mention of a Yearly reporting, (I lived in Spain at the time) when I had my stroke in 2012, I retired and came to the PI, I knew that 2014 was the new ACR card time but when I arrived in Manila, I was told it had been rescinded and was given the 21 day entry. It had never been updated in January 2010 (I was still in Spain) Now the Embassy and BOI have decided. " I Should have known the Rules" What rules? and if they choose to change them, which they do, what chance do any of us have. I might add here, none, of the relevant PI Government Departments are interested in looking into the issue. They just say you will have to re-apply in the normal way. Now of Course, we have this Ludicrous issue of the Police Check. This was never, an issue when I first got my Residence. ( I lived in Spain for over 15 years,) The UK know little of me so how can they issue a Clearance. The whole thing Stinks of Corruption, at I am safe in saying, at the very Highest level. They will not, accept a Translation of the Spanish Police Clearance, as I am British. Base fact is! If you don't do as they wish, you can and will get reverted to a 9a Tourist. the rules will change. The nearer, we get to a Costly Fiesta time for this Country, the more the rules will change, Just like I encountered in Spain. Mike! it goes even further than this, I have a communication from Madrid RP Embassy that tells me, they are not and I repeat NOT allowed to authenticate a Police clearance. WTF is going on here.
