Right-of-Way Easement

    I have heard many horror stories regarding right-of-way problems if you buy a lot requiring an easement through another's property. If you were to buy a lot requiring a right-of-way, is the safest and legal process to have it written in the deed of sale that you have the necessary access or is it a separate legal document, given the deed of sale would be for the lot you are buying and not include the other's property?

    Related question: Do any of you or your wife's family have lots that produce coconuts as income? I know it is not a good return on investment depending what you pay for the lot but I am looking for an income source for in-laws.

    Our farm grows coconuts, but all the trees are newly planted except one. There are a few copra buying stations around. I would check there to see what they are paying and have the wife do it as the foreigner price may be lower. I can't see how 50-120 coconuts yearly off of one tree can be a losing proposition! Just make sure, if you plant new ones, that they do not shade you, or the neighbors crops.

    Thanks. There are 100 trees producing trees and I understand they produce every 3 months. There is room to grow corn and other vegetables, more for living off the land that for sale. The seller put a "foreigner tax" on his sale price but my offer is much lower so will see if he takes it. It is in Dauin up the hill. I have to solve the right-of-way issue.

    :confused: Pat have a look at this Site, Chas Robles has much the Same, Seems you may fall in line for a Compulsory Easement. There is a FAQ section there too. Hope you get it all sorted.
