The case is SESSIONS v. MORALES-SANTANA and is in regards to different rules set in place for passing citizenship to children born abroad to those unwed. Men faced a longer term required living in the US then women. The opinion comes down to "We hold that the gender line Congress drew is incompatible with the requirement that the Government accord to all persons “the equal protection of the laws.”"

This same ruling should if pushed have application forcing the US Embassy to require that unwed mothers and fathers be given the same burden no matter a doctor witness the birth or not. Further the doctor could be lying as well and is no more apt to be trusted then the claimed father signing the birth certificate that day. Further what about if the woman was merely a surrogate and not the biological mother, another sticky argument.

The case if want a read is

I'm curious if one could challenge the DNA testing using the new SCOTUS ruling that just came out dealing with passing citizenship that men and women MUST have the same standards and one can't have a burden the other doesn't have. Women aren't required a DNA test and its logical if the father was there at the time of birth to sign the birth certificate as well the exact same standards are required in passing citizenship. Its now considered unconstitutional for one gender to have a different bar then the other in such cases.

If the old man is collecting U.S. social security and claims the child, his monthly check will increase by 50% until the child turns 18 (19 if still in high school). The father could use the extra money to pay the child support.

She went to the consulate because she was told that they would check over the paperwork and make the appointment for her. I've seen the checklist but her situation is a bit "difficult". The "father" is lazy, broke, not very bright, doesn't care about the kid, gets upset and threatens to not do the paperwork or withhold child support anytime he is asked if it is done, lost his passport 5 years ago and never reported it, doesn't have a valid visa to stay in the Philippines, was married to another Filipina with a kid, currently has an additional Filipina pregnant, is very likely senile and is just a shitty human being in general. If he doesn't get his sh*t together and stop acting like a complete piece of sh*t I will likely help this young lady make what is left of his pathetic life very very difficult.
